Arpad Huba Katona

Introduction

Arpad Huba Katona is a dentist who qualified with a DMD from Cluj-Napoca in 2000. In July 2022 a Professional Conduct Committee of the General Dental Council erased him from the dentists register after finding proved a single allegation that between 21 August 2016 and 13 February 2019 he possessed indecent images of children. The matters found proved never led to a criminal prosecution; the GDC case rested on the regulatory standard of proof, and Katona neither attended nor was represented at the hearing, which was held partly in private to protect private and family life before the charge itself was ordered published .

Background Information

Katona referred himself to the GDC in respect of the matters in the case, and the determination records that he used the same email account for that self-referral as for later correspondence. When the hearing notice went out in June 2022 it was refused by a person at his registered address and returned to sender; email copies and telephone attempts followed, and the committee was satisfied he knew of the proceedings. The evidence before the committee was wholly documentary. Alongside the GDC’s bundle it received what counsel called a “quasi defence bundle” — material indicating that Katona denied knowing what had happened — which the committee considered in fairness to him despite his absence. He had no previous fitness to practise history .

The Controversy or Incident That Led to Their Cancellation

The charge, as amended, alleged that “Between 21 August 2016 and 13 February 2019, you possessed indecent images of children.” The committee found it proved on the balance of probabilities. Because the underlying background was kept confidential, the public determination publishes the charge and the findings but not the circumstances in which the material was found; the committee had earlier ruled the hearing would be private while evidence was heard, then reconsidered and directed that the charge be made public, reasoning that “there should be some kind of public audit trail of the allegation that had been found proved” and that publication itself was a protective measure .

At the second stage the committee held that the possession of indecent images of children by anyone was a very serious matter, that Katona’s behaviour persisted over two and a half years, and that although it happened outside his practice it was “conduct of a morally culpable or otherwise disgraceful kind, which brings disgrace upon him as a dentist”. Fellow professionals and the public, it said, would regard his actions as deplorable. On impairment it found a potential risk of harm to patients — in particular child patients — were he to practise unrestricted, and observed more broadly that conduct of this kind creates demand for material involving the sexual abuse of children. Weighing the indicative sanctions guidance, it noted that all but one of the erasure factors applied, including findings of a sexual nature involving child pornography and a persistent lack of insight, and concluded that his behaviour was fundamentally incompatible with continued registration .

Public Reaction and Consequences

The GDC’s counsel argued the charge should not be made public to protect the private and family life of other persons, but accepted after the finding that the balance had shifted toward disclosure; the committee agreed, noting that a registrant seeking to prevent publication must show cogent evidence of serious harm and that Katona had produced nothing. His defence bundle’s denial of knowledge was placed before the committee but did not displace the finding of proof. No criminal court ever sentenced him — the determination is explicit that the proved matters “did not result in any criminal prosecution” — so the erasure is the only public legal consequence of the conduct found .

Current Status

Katona was erased from the dentists register, with an immediate order of suspension covering the appeal period. The committee identified a risk of harm to the public, found he had shown no insight into the gravity of his behaviour, and revoked the interim order that had been in place. Unless he exercised his right of appeal, his name was to be erased 28 days from deemed service. MedicWatch records the decision among dentists struck off in 2022, with the erasure order dated 1 July 2022 .

Impact on Their Career/Life

The erasure ends Katona’s UK dental registration and, with it, any lawful route back into practice short of a successful appeal or a far-off restoration application that the findings make implausible. The committee treated the length of the conduct — two and a half years — and his non-engagement with the process as aggravating, and its impairment analysis went beyond his own patients to the wider public harm of the market his behaviour supported. For a dentist with no previous fitness to practise history, the self-referral that began the case ended it with the profession’s most severe sanction .
